Terms of Service

Prices are subject to change at any time.

I retain the right to accept or decline any commission.

The ETA (Estimated Time of Arrival) displayed are approximations, and may vary depending on the complexity of the commission requested and the amount of workload I'm currently handling.

You will only receive a digital file of the commissioned art, not a physical product or item.

The payment method is a digital transfer via Paypal (USD) or Mercadopago (ARS).

Payment must be either 50% of the full price upfront or 100% of the full price upfront.

If payment was 50% upfront, I will ask for the rest of said payment at the moment of completion of the requested commission.

I will not start to work on the commission until a payment is received.

Once I receive the full sum of the payment, the commissioned art will be delivered.

The commissioned art will be delievered in full resolution via e-mail as a PNG document, or MP4 document if it's an animation.

The commissioner may ask for one major revision during the sketch phase, and one minor revision after the linework and base color are done.

If any major revision is requested after the linework and base color are done, an additional payment will be asked of the commissioner.

Said payment will be 20% or more of the original price of the commission, varying on the complexity of the revision.

Refunds will be issued partially or in full depending on the category and progress of the commission.

Refunds are applicable if I can't finish the commission because of a personal issue.

Refunds are applicable if the request of the commission is canceled before I start working on it.

Any refund will be done by me. I will contact you, the commissioner, and will personally transfer the money directly to you.

If a Paypal chargeback is requested, you will lose all rights to the commissioned piece stated in this document and I will have the full right to profit further from it in any capacity. I will decline the chargeback and supply Paypal with the necessary evidence to nullify said chargeback. Furthermore, you will be blacklisted for commissioning me again.

I, Franco Barria (the artist):

I retain all copyrights over the commissioned artwork.

I will NOT claim the intellectual property (IP) of the commissioned artwork.

I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.

I reserve the right to post the commissioned artwork online, in my portfolio, etc.

You (the customer/commissioner):

You retain the rights to the intellectual property if applicable (IP).

You may upload the commissioned artwork on any website and social channels with proper credit of the artist.

You can not use the commissioned art for AI training or any other type of artificial image generation.

You can not use the commissioned art commercially or use it to gain any kind of profit, be it fungible or non-fungible.

You may not alter the commissioned artwork without my (the artist's) consent.

You can not state the commissioned art was made by yourself.

The following is considered copyright infringement:

Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.

Claiming the artwork as your own in any capacity.

Altering the artwork in any way without my consent.
